SALE TERMS

The following terms and conditions ("sale terms") apply to the purchase of products, gift cards, and/or e-gift cards ("merchandise") from the hemener website. By placing an order for merchandise, you are confirming your acceptance of and agreement to be bound by these sale terms if any of the following situations apply to you: (i) you placed an order via hemener.com (desktop or mobile), (ii) you placed an order via the hemener mobile app, (iii) you placed an order through a hemener microsite, or (iv) you placed an order with hemener via telephone. Any order that falls under situations (i) through (iii) may be referred to as an order purchased from the hemener 'website.'"

Please review and save a copy of these sale terms for your personal records prior to your placement of each order, as these terms are subject to change. ORDER AND ACCEPTANCE

Each part of an order submitted to Hemener constitutes an offer to purchase merchandise. When you place an order through the Hemener website, you will receive an email confirmation acknowledging receipt of your order, typically within minutes. If you do not receive this confirmation email, please contact Hemener's customer service using the contact information provided above before placing a duplicate order. Please note: Receipt of confirmation does not guarantee acceptance of your order or payment processing.

 Hemener does not consider any part of your order accepted until the merchandise has been shipped and you have received a shipment confirmation email. A tracking number will be provided, allowing you to monitor the progress of your order.

If your order is rejected due to a pricing error or incorrect information about the merchandise, Hemener will notify you via the email address provided. Once the error is corrected, Hemener will ask whether you would like to resubmit your order or cancel the transaction. If you have already received a shipment confirmation email, you will not be required to pay a price higher than what was displayed on the Hemener website at the time of purchase.

In certain locations, you may use Paytm, MobiKwik, or UPI to pay for your purchases. In such cases, payment will be collected at the time of placing the order, covering the full purchase amount, including any shipping and handling charges. If you choose to cancel all or part of your order after using Paytm, MobiKwik, or UPI for payment, you will receive an email with a link to provide the necessary bank details. Refunds can be expected within seven (7) business days and will be issued in the same currency in which the order was placed.

If you receive merchandise that differs from its description on the Hemener website at the time of purchase, you may request a return or exchange. Please note: If you paid using Paytm, MobiKwik, or UPI, you can only return the merchandise in full and place a new order if desired. For more details, please refer to the Hemener Returns and Exchanges Policy.


Although unlikely, Hemener reserves the right to deny an order for any reason, including but not limited to errors in billing, payment, or shipping information.

Some orders may not be processed due to incorrect information provided, including but not limited to an invalid credit or debit card number, expiration date, or security code.

Other incorrect payment-related information that may prevent order processing includes:

Incorrect billing information (e.g., the billing details provided do not match those on file with the financial institution).
Insufficient or incorrect shipping address details (e.g., missing or incorrect street address, city, state, ZIP/postal code, etc.).
Suspected fraudulent information.

 

Delayed Shipment or Merchandise Unavailability
If an item is delayed at the Hemener fulfillment center, becomes unavailable, or if an error occurs on the Hemener website related to your order (such as incorrect pricing or item description), Hemener reserves the right to cancel the order.

In such cases, we will notify you of the cancellation via the email address provided at the time of purchase.

Reshipping of Merchandise
Hemener does not allow reshipping of orders under any circumstances. Orders shipped to a freight forwarding company will not be accepted.

Resale of Merchandise
Hemener is a private label brand, and to protect our intellectual property rights, we strictly prohibit the resale of merchandise for personal or business profit.

Orders suspected of resale activity will not be accepted. Additionally, Hemener reserves the right to cancel any future orders from customers identified as engaging in reselling.

 

Previous Fraudulent Order History
Hemener reserves the right to reject any order suspected of fraudulent activity. This includes, but is not limited to, cases where:

The customer has a history of fraudulent orders
The order is linked to a previous credit card dispute
Additionally, Hemener may refuse any future orders from customers with a record of fraudulent transactions and take legal action against such fraudulent activities to the fullest extent permitted by law.

Shipping to a P.O. Box
Hemener does not accept orders for delivery to P.O. Box addresses. All orders must be shipped to a valid physical address to ensure proper delivery.


Gift Cards and E-Gift Cards
Gift Cards and E-Gift Cards may only be purchased and redeemed in INR on the Hemener website. All sales are final and non-refundable. Purchases and usage of Gift Cards and E-Gift Cards are subject to the terms outlined in the "Gift Card Details" (available on the Gift Card page) and "E-Gift Card Details" (available on the E-Gift Card page).

Engagement with Hemener and Affiliates
Hemener and Shvastra Online Shopping (collectively referred to as the “Company”) reserve the right to remove and/or unsubscribe any email address, phone number, and/or mailing address from all Company platforms and marketing communications if the customer is determined to exhibit characteristics of reselling or fraudulent activity.

Company platforms affected by such actions include, but are not limited to:

Online accounts registered with the Company
Email marketing lists
Direct mailing lists
Additionally, customers identified as resellers or involved in fraudulent activities may be prohibited from accessing and/or registering for any of the above-mentioned platforms in the future. If necessary, Hemener reserves the right to take legal action against individuals or entities found engaging in fraudulent activities or unauthorized reselling.

 

Customer-Initiated Order Cancellations and Changes
You may modify or cancel your order before it has been packed at the Hemener Distribution Center by contacting Hemener Customer Service via:

If Your Order Has Already Been Packed:
Orders Paid in INR: You may return or exchange your merchandise for a refund or replacement at any of our stores located in India.
Orders Paid in Other Currencies: You may return or exchange your merchandise for a refund or replacement by sending it back to us, subject to Hemener’s Returns and Exchanges Policy. However, such orders cannot be returned or exchanged at a physical store in India.

Merchandise on Backorder
Merchandise listed as backordered is temporarily out of stock. If Hemener is unable to ship any backordered item within thirty (30) days from the date of your order, you will be notified via the email address provided.

Payment: You will not be charged for backordered merchandise until it has been shipped.
Shipping Charges: Shipping and handling fees are distributed proportionally to the cost of each item in an order. You will not be charged shipping fees for backordered items until they have been shipped.
Shipping Method: All items in an order will be shipped via the shipping service you selected at the time of purchase.

Price Adjustments
Orders Shipping to India
If you have purchased merchandise from the Hemener website, and the price of an item (same color and size) has been reduced after your purchase, you may request a price adjustment within seven (7) days from the date of your order.

Important Conditions:

Price adjustments apply only to merchandise purchased at the original sale price.
Each item is eligible for only one (1) price adjustment.

Make sure to include your order number and details of the item(s) you believe qualify for a price adjustment.

Payments
Credit Card Transactions: Hemener reserves the right to request additional billing information for all credit card purchases.
Debit Card Transactions: All debit card payments will be processed as credit transactions.
Statement Charges: The charge for your order will appear as "HEMENER.COM" on your credit card statement.

Payment Methods & Currency
Paytm, Mobikwik, and UPI payments are available only in INR.

Currency Conversion & Fees
Purchases made in a currency other than INR may incur a conversion fee, which will be factored into the merchandise price.
Due to fluctuating exchange rates, prices in other currencies may differ from INR prices.
If you use a payment card issued in a different currency, your card provider may charge additional conversion fees.
Fraudulent Chargebacks & Legal Action
Hemener will prosecute fraudulent attempts to reverse valid charges for delivered orders to the fullest extent of the law.
If your order is cancelled, authorization holds will be removed within 3-5 business days.

Limitation of Liability
Hemener shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the sale of merchandise.
Some jurisdictions do not allow limitations of liability, in which case the above limitations may not apply.

By completing an order on the Hemener website, you agree to abide by the Website Terms of Use.
Any personal information provided is subject to Hemener's Privacy Policy.
Hemener operates from its offices in Delhi & NCR, India, and these Sale Terms are governed by the laws of Delhi and Haryana, without regard to conflict of law principles.
These Sale Terms apply only to Hemener and its customers; no third party shall have any rights to enforce them.
If any provision of these Sale Terms is deemed unenforceable, it will be removed, but the remaining terms will continue to be in effect.
